Automobile Accident Attorney | Pocatello | KUMM & REICHERT, PLLCAuto Accidents

Idaho follows a “fault” system regarding insurance coverage and liability issues resulting from an auto accident. In other words, the person who was at fault for the accident is liable for personal injury or property damage, and his or her insurance policy will usually be looked to first when seeking compensation for any losses. Idaho residents injured in auto accidents may seek compensation by either a) Filing a claim with his or her insurer, b) Pursuing a claim with the other driver’s insurer directly, or c) By filing a personal injury lawsuit in civil court.

Wrongful Death

Idaho state law defines “wrongful death” as the death of one person caused by the “wrongful or neglectful act of another.” In the event that such a death occurs, the heirs or personal representative of the deceased may bring a claim to court seeking damages from the person or party that allegedly committed the wrongful and/or neglectful act that led to the decedent’s death. Family members and heirs are also eligible to file claims on their own behalf for damages they suffered as a result of the untimely loss of their loved one – i.e. pain, suffering and emotional distress.

Family Law

Family Law Attorney | Pocatello | KUMM & REICHERT, PLLCWhether you are dealing with a failed marriage, child custody dispute or the complexities of adoption, there is nothing easy about family law. The attorneys at KUMM & REICHERT, PLLC understand this, which is why they have dedicated their professional careers to helping Pocatello and Soda Springs residents with any and all family-related disputes. If you are currently contemplating a divorce, or if you simply have a question regarding child custody, spousal support or adoption, please call our office today for your free 30-minute consultation.

Adoption provides a child with a stable legal and emotional family relationship, including the legal transfer of all parental rights from the child’s biological mother and father to the adopting person or couple. Adoptive parents have the same rights and responsibilities to their child as biological parents. Families interested in domestic or international adoption gain eligibility by completing an adoption home study. The need for an adoption home study for grandparents and step-parents hoping to adopt their grandchild or step-child is determined by the court, but keep in mind that all families adopting a child through the child welfare system must have an approved adoption home study.

Child Custody

Under Idaho state law, if both parties fail to agree on how to share custody and parenting time, a judge will make a decision awarding legal and physical custody to one parent, or will order the parents to share joint legal and physical custody. When making these custody decisions, the court must determine what is in the best interest of the child, such as the child’s wishes regarding their custodian, their relationship with both parents, the child’s relationship with other siblings who are in the care of either parent, each parent’s fitness to parent, the child’s involvement in school and/or the community and the need for stability in the child’s life.

In order to file for divorce in Idaho, you must have lived within state lines for at least six weeks. Since Idaho adheres to the “no-fault” divorce system, the reason(s) as to why the marriage failed need not be explained upon filing for divorce. Simply stating that the marriage suffers from “irreconcilable differences” will suffice.

To file for divorce (without children) in Idaho, you must submit a family law case information sheet, complaint for divorce, summons with orders, affidavit of service with orders and a vital statistics certificate of divorce.
